It faithfully describes how the service works as of the date shown at the top of this page and will be updated whenever the service changes, or after legal review.
Purpose and acceptance
These terms govern access to and use of the VodRush service. By creating an account or submitting a VOD, you accept them.
If you do not accept these terms, do not use the service.
What the service does
VodRush turns a VOD into vertical clips. You provide a VOD link, the service fetches its audio track, transcribes it, automatically finds the passages most likely to interest an audience, then produces 9:16 clips you can watch, keep or reject, and download.
The service is automatic and statistical. It guarantees neither the relevance, nor the quality, nor the exact number of clips produced for any given VOD.
VodRush posts nothing on your behalf. No clip is published to a social network: you download your clips and post them yourself, when and where you decide.
Account and eligibility
Using the service requires an account. You must have the legal capacity to enter into a contract and be at least 16 years old.
You are responsible for keeping your credentials confidential and for all activity carried out from your account. An account is personal: it may not be shared or resold.
Rights in submitted VODs
VodRush performs no technical ownership check on submitted links. The service relies on your declaration.
By submitting a VOD, you declare and warrant that you hold the necessary rights in that content, or that you have sufficient permission to produce a derivative work from it, and that this processing complies with the source platform's terms of service.
This declaration is an essential condition of the service. Liability for a VOD submitted without the corresponding rights rests first with you.
Acceptable use
Breaching any of the rules below may lead to your account being suspended or closed, as set out under "Suspension and termination". You agree not to use VodRush to:
- process unlawful, hateful, violent or child-abuse content, or content that invades someone's privacy;
- circumvent the technical protections or the terms of service of a third-party platform;
- infringe a third party's intellectual property rights;
- disrupt the service, probe it automatically, or attempt to bypass its usage limits;
- resell or redistribute access to the service.
Reporting and takedown
If you believe content processed through VodRush infringes your rights, write to contact@vodrush.com stating your identity and contact details, a precise identification of the content concerned, the basis of your rights in it, and a good-faith statement.
Admissible reports are handled as promptly as possible: the content concerned is deleted, and the account that submitted it may be suspended in the event of a serious or repeated breach.
For rightsholders under United States law, this same contact serves as the designated agent for DMCA (Digital Millennium Copyright Act) takedown notices; a DMCA-compliant notice is handled through the same process.
The service neither publishes nor hosts any public catalogue: clips are visible only to the user who submitted the VOD, subject to the restricted, logged team access described in the privacy policy, and are deleted at the end of the retention period stated in the privacy policy.
Ownership of content
You remain the owner of your VODs and of the clips generated from them.
You grant VodRush a limited, non-exclusive and strictly technical licence, for the duration of the processing and retention described in the privacy policy only: to fetch the audio, transcribe it, analyse it, fetch the video segments required, and produce your clips. This licence allows neither publishing, nor sharing, nor commercialising your content.
VodRush remains the owner of the service itself, its trademarks and its software components. These terms transfer none of them to you.
Trial, subscriptions and payment
The service offers a free trial, with no credit card, limited to one VOD, then paid subscription plans billed either monthly or yearly. The plans and the prices in force are set out on the home page and prevail.
Payments are handled by Stripe. No card data passes through our servers and none is stored there.
A subscription can be cancelled at any time and ends at the close of the current period. Amounts already paid for the current period are not refunded pro rata, save where mandatory law provides otherwise.
A yearly subscription is paid once for twelve months. The VOD quota stays monthly: it renews on each monthly anniversary and does not accumulate or carry over from one month to the next. Cancelling a yearly subscription stops the renewal and access is kept until the yearly term ends, with no pro-rata refund of the remaining months.
Prices may change. A price change never applies to a period already paid for.
Availability and retention
The service is provided as is, with no guarantee of continuous availability. Interruptions may occur for maintenance, incidents, or the failure of a third-party provider.
VodRush is not a storage service and does not archive your content: the audio track is deleted as soon as processing finishes, and generated clips expire after the period stated in the privacy policy. Download your clips before they expire.
Liability
You are responsible for the content you submit, for the use you make of the clips produced, and for complying with the terms of the platforms you publish them on.
To the extent permitted by law, VodRush's liability is limited to direct and foreseeable damage, and capped at the amount you paid for the service during the twelve months preceding the triggering event. Indirect damage, in particular loss of revenue, audience, content or data, is excluded.
Nothing in these terms limits the rights that law grants consumers on a mandatory basis.
Suspension and termination
You can close your account at any time from your settings. Closing it erases your data as described in the privacy policy.
VodRush may suspend or close an account that breaches these terms, in particular the rights declaration or acceptable use. Except in an emergency or a serious breach, suspension is preceded by a warning.
Changes to these terms
These terms may change along with the service. The last-updated date is shown at the top of this page, and a substantial change is notified to you by email or in the app before it takes effect.
Continuing to use the service after a new version takes effect constitutes acceptance of it.
Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first: write to contact@vodrush.com.
Failing agreement, the dispute falls to the competent courts. If you are a consumer resident in the European Union, you keep the benefit of the jurisdiction rules of your country of residence.
